What is Freedom of Information?
The Freedom of Information Acts, 1997 & 2003 provides that every person has the following legal rights:
- The right to access official records held by public bodies listed in the Act.
- The right to have personal information held on them corrected or updated where such information is incomplete, incorrect or misleading.
- The right to be given reasons for decisions taken by public bodies that affect them.
The Affordable Homes Partnership and Local Authorities are governed by the Freedom of Information act. Check with your local authority to find out what their Freedom of Information obligations are.
Specifically with regard to the Affordable Homes Partnership, the Act requires the Partnership to respond to requests from the public for information held by the Affordable Homes Partnership.
FOI Obligations for the Affordable Homes Partnership
- Acknowledge receipt of the request within two weeks.
- Make a decision within four weeks of the receipt, eight weeks in certain cases.
- If the Affordable Homes Partnership does not respond within four weeks the request is deemed to have been refused and the requester can proceed to the review stage.
